Terms Of Service
Here is the part most clients never read. The Web Squeeze, LLC, DBA Collision Hosting, wants to simplify this as much as possible. We will do everything possible to make you a happy customer and in return, we expect you to treat us with respect and not take advantage of our good nature. Please read these terms of service, as signing up with us indicates you have done so and agree to them. Any violation will result in the termination of your account.
Account Setup
You are required to identify yourself to us and to provide payment, in advance, for the requested services. You must list an email address which is not at the domain you are signing up under so that we may contact you if there is a problem and your site is down. In some high risk transactions, such as the purchase of a dedicated server or other more expensive contracts, it will be necessary that you provide us with acceptable identification and possibly a scan of your credit card. We reserve the right to refuse or hold your order if you fail to meet these requirements, if there is reason to suspect fraudulent activity, or for any other reason staff determines to be valid.
Migration Assistance
We know moving to a new provider can be a pain. For an additional fee, our team will get rid of this headache for you. We will “migrate” your entire website, including files, settings, databases and sometimes even e-mails, over to our servers. You don’t have to worry about downtime at all. If a website is moved correctly there is never downtime. We have loads of experience with this and are happy to help you. Payment
Payment is due in advance and upon order. You can configure your terms of payment and this is posted on your dashboard. You will receive an invoice due reminder 5 days before the billing cycle renews. One day after the due date has passed you will get another notice. After three days, we will suspend your account and a 15% late fee will be added. Your account will be terminated after 30 days.
Content
We operate in compliance with all applicable Federal, State and City laws in the United States of America. We will immediately spill our guts to any law enforcement agency who presents us with a lawful request. As a customer, you agree to make yourself aware of the laws governing content and usage. Any violation of law will result in the possible removal of offending material from your website or of its suspension. We probably don’t even have to mention this, but the following will not be tolerated:
- Unauthorized use of copyrighted or trademarked material or links and forums for their distribution.
- Sites promoting illegal activities, or pirated software and music.
- Hateful, racist, harassment oriented websites.
- Fraudulent sites .
- Pornography, nudity, and sex-related merchandising or any other material we judge to be obscene.
- Bulk email related products and of course SPAM !
- Hacking or any similar activity or content
Collision Hosting has full discretion on matters of acceptable content and reserves the right to deactivate and remove any site at any time for any reason without refund!
Cancellation and Refund
Collision Hosting offers a seven day risk free guarantee. You may cancel within this time and get a free refund if you are not completely satisfied with our services. Should you wish to cancel your existing account you should provide us 72 hours notice and your account will be terminated on your due date. There are no refunds on dedicated servers, administrative fees, or migrations services. In order to cancel or request a refund, you should submit a support ticket to our billing department at (LINK) or call us at PHONE. In addition, we reserve the right to cancel, suspend, or restrict access to your account at any time with or without notice, due to a violation of the TOS. Any abuse of our staff in any format will be considered grounds for termination of service.
Backups and Data Loss
You are solely responsible for the backup of your website. We offer a friendly interface to assist you with this. C-Panel will allow you to backup your website on a regular basis and you have several options for storing your backups or your customer’s websites if you are a re-seller. You agree to take full responsibility for files and/or data residing on your account. That being said, if your world crashes and you lose all or part of your site and related files, submit a support ticket and we’ll try to help. No promises, but we are empathetic to your plight and will act accordingly.
Bandwidth/Resource Usage
We will monitor our servers to ensure the highest uptime, speed, and reliability. If your website is found to be consuming an excess amount of the server’s resources, we will ask you to upgrade or may even terminate your service if the excess usage is related to illegal practices. If you think your site may require high resources, you should discuss this with us in advance at: Sales@CollisionHosting.com. Remember we are not a backup provider. We provide website hosting and allow you to store as much as is allotted to your account for your website. We cannot allow you to use your account for backup storage except as provided through your cPanel access.
Here is a guide as to excess resource usage. You may not use more than 25% of system resources for longer than 90 seconds. Numerous activities could cause such excessive usage including :
- Using CGI scripts, FTP, PHP, HTTP, etc.
- Running stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
- Running any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
- Using any software that interfaces with an IRC (Internet Relay Chat) network.
- Using any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
- Participating in any file-sharing/peer-to-peer activities
- Running any gaming servers such as counter-strike, half-life, battlefield1942, etc
- Running cron entries with intervals of less than 15 minutes.
- When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”)
Resellers
Collision Hosting does not provide support services to third parties. Resellers are responsible for supporting their own clients and you must make all support requests on behalf of your clients for security purposes. You are also responsible for any of your clients who violate the law or these terms of service.
Dedicated Servers
We are not responsible for backing up dedicated servers. It is your responsibility to maintain backups or create a backup solution for your dedicated server. We recommend purchasing an extra hard drive for your server for backup storage. We recommend you keep your current root password on file so that we can properly maintain the security of your server and continue to provide support for you, should you require our assistance. Should you forget or lose your root password, you may contact our support team to have this reset.
Indemnification
You agree to defend, indemnify, save and hold harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Collision Hosting, its agents, customers, officers and employees, that may arise or result from any services provided or performed. This includes liabilities arising out of injury to person or property, infringement upon proprietary rights of a third party, copyright infringement, or any defective products sold from the server of Collision Hosting.
Conclusion
We cannot possibly list rules regarding all the crazy things that people do. Suffice it to say that we will be as fair and equitable as is reasonably possible. We reserve the right to amend and change our terms of service without notice. Any changes apply to all Collision Hosting accounts. Your continued use of our service constitutes agreement to any changes in the terms of service.
